00:01 - 00:02
Hello, My name is Dallas.
00:02 - 00:05
I am coming today to talk about the key employment
00:05 - 00:09
laws that some of them managers will be dealing with
00:09 - 00:12
thes air laws that I believe that every manager should
00:12 - 00:13
have a working knowledge of.
00:14 - 00:19
Firstly, we'll talk about equal equal employment opportunity laws first,
00:19 - 00:20
beginning with the Civil Rights Act of 1964.
00:22 - 00:24
This was the beginning of employment equality, and it deals
00:24 - 00:26
with discrimination during the hiring process.
00:27 - 00:30
This legend legislation states that there should be no discrimination
00:31 - 00:35
in the hiring process based on, um, six age and
00:36 - 00:40
race. Furthermore, there are some states that also stated that
00:40 - 00:42
it should not be based on sexual orientation.
00:43 - 00:44
So we need to make sure that we're not asking
00:44 - 00:48
questions during an interviewing process that could lead to these
00:48 - 00:49
type of discriminatory responses.
00:51 - 00:53
Secondly, we have the affirmative action plan.
00:53 - 00:56
This makes workplaces more day burst and does not exclude
00:56 - 00:57
minorities within the workplace.
00:58 - 01:02
This legislation basically advocates for a more diversity, making sure
01:02 - 01:07
that we're offering positions two individuals that have different backgrounds,
01:08 - 01:12
so we're not working on an all male Caucasian workforce.
01:13 - 01:15
Furthermore, we have the Americans with Disabilities Act that prohibits
01:16 - 01:17
discrimination with those that have disabilities.
01:18 - 01:21
So within our postings in our job ads, we can
01:22 - 01:25
say we need individuals to be ableto lift £30 or
01:25 - 01:27
more if the job dictates that.
01:28 - 01:31
However, what we cannot post is that we do not
01:31 - 01:36
want anyone with disabilities that is completely unnecessary, and it
01:36 - 01:38
also limits our workplace scope.
01:38 - 01:40
We want to include diversity.
01:40 - 01:43
We want different individuals open mind sets to come into
01:43 - 01:43
our workforce.
01:44 - 01:47
So as a whole, a few tricks or tips, I
01:47 - 01:49
should say, to make sure we're not running into any
01:51 - 01:55
legislative, you know, backlash is that when we were interviewing,
01:56 - 01:59
when we're posting any type of job, ads were making
02:00 - 02:03
sure that we're asking and posting the same being all
02:03 - 02:03
in uniform.
02:04 - 02:07
So we're making sure that everybody gets asked the same
02:07 - 02:10
interview questions, and we are documenting the answers.
02:11 - 02:14
That way, if we are accused of discriminatory behavior during
02:14 - 02:17
the hiring process, we can turn around and show that
02:17 - 02:19
we indeed or not, or if it is a situation
02:20 - 02:22
like that, we can take the necessary actions against whoever
02:23 - 02:23
needs to be addressed.
02:25 - 02:26
Next, we have employee health.
02:27 - 02:29
We have two different bodies that kind of monitor employee
02:30 - 02:32
health. The 1st 1 is the Occupational Safety and Health
02:33 - 02:34
Act, otherwise known as OSHA.
02:35 - 02:38
OSHA has standards in which all workplaces have to work
02:38 - 02:44
to. For example, maybe OSHA states that every workplace has
02:44 - 02:46
tohave to tornado shelters in the Midwest.
02:47 - 02:50
Um, and if they come audit, they do their annual
02:50 - 02:52
review on us, and they find we only have one
02:52 - 02:55
located. We can be subject to fines if not corrected.
02:56 - 02:58
Um, OSHA leads to safer workplaces.
02:59 - 03:02
Safer workplaces means less injuries and less injuries mean a
03:02 - 03:03
more secure company.
03:04 - 03:06
So making sure that our replaces air safe for both
03:07 - 03:08
our employees and our employers.
03:09 - 03:12
Secondly, we have the Affordable Care Act, and it made
03:12 - 03:14
it. The individuals are to receive health care.
03:15 - 03:16
It also makes it so.
03:16 - 03:20
Health care Private providers cannot discriminate against pre existing diseases.
03:21 - 03:24
Eso basically how this kind of implements into our company
03:25 - 03:26
is that we want to make sure that our health
03:26 - 03:27
care options are ideal.
03:28 - 03:30
If we don't have a health care plan that looks
03:31 - 03:33
good to our employees, it's pretty much obsolete.
03:33 - 03:35
We're not paying for a whole pot.
03:35 - 03:38
We're paying the premium every month for a bunch of
03:38 - 03:39
people not wanting it.
03:40 - 03:43
I think the best resolution for employee health is to
03:43 - 03:46
have committees in the company address this.
03:46 - 03:49
Have committees take a look at OSHA, see how we
03:49 - 03:51
hold up during those regulations and seeing what we can
03:51 - 03:54
or correct to makeover place safer and also having a
03:54 - 03:57
committee to evaluate whether or not our health care plan
03:57 - 04:00
is actually doing what needs to.
04:00 - 04:02
It needs to be appealing to our employees and if
04:02 - 04:06
it's not finding a way to change it next, we
04:06 - 04:06
have labor laws.
04:07 - 04:09
There's three different ones that I want to talk about.
04:10 - 04:12
They deal with pay, retirement and labor standards.
04:13 - 04:15
The 1st 1 is the Equal Pay Act of 1963
04:16 - 04:19
and this allows no discrimination and pay based on certain
04:19 - 04:23
criteria. What that means is that there could not re
04:23 - 04:26
discrimination based on race, age or gender.
04:28 - 04:32
However, we can provide pay raises on other things, such
04:32 - 04:39
as seniority in the company, documented annual, um, evaluations or
04:40 - 04:44
even substantial substantive perk Russian towards company goals.
04:45 - 04:49
Those certain things can be or can make an individual
04:50 - 04:52
eligible for a pay raise, but we want to make
04:53 - 04:55
sure we're not basing it off of non work related
04:56 - 05:00
things. So based on credentials and merit, we have a
05:00 - 05:03
wrestle, which is the Employee Employee Retirement Income Security Act
05:03 - 05:03
of 1974.
05:05 - 05:06
And they said, the standards for retirement plans.
05:07 - 05:10
So making sure that all employees understand what they're getting
05:10 - 05:11
into whether money is going.
05:12 - 05:14
And it also makes sure that someone is monitoring their
05:15 - 05:16
retirement plans at all times.
05:17 - 05:21
And lastly, we have the Fair Labor Standards Act, which
05:21 - 05:23
kind of talks about minimum wage child labor laws in
05:23 - 05:26
overtime as far as minimum wage and child labor laws.
05:27 - 05:32
Um, this is federally mandated, but there are also state
05:32 - 05:34
white things that we need a monitor as well.
05:35 - 05:38
So whatever state we are in, um, we need to
05:38 - 05:41
make sure that where you are following those regulations and
05:41 - 05:44
making sure we are giving her employees the minimal age
05:44 - 05:49
and we're not hiring minors in overworking them over time
05:49 - 05:50
is really interesting subject.
05:51 - 05:53
We want to make sure we're paying our employees.
05:53 - 05:57
If over time does happen, you cannot simply right off
05:57 - 05:57
the books.
05:57 - 06:00
The employees do need to be credited for the time
06:00 - 06:01
that they work in our company.
06:01 - 06:04
Now, this is accumulating, and there is a lot of
06:04 - 06:04
different places we have.
06:05 - 06:07
Over time, we can talk about staffing those specific places,
06:07 - 06:10
but as it stands over time does need to be
06:10 - 06:11
paid for.
06:12 - 06:13
And lastly, we have unions.
06:14 - 06:15
Um, you use a really interesting.
06:16 - 06:18
They used to be really popular 10 to 20 years
06:18 - 06:21
ago. Um, now they're not so much.
06:21 - 06:24
Just because I work places are, um, a little bit
06:24 - 06:26
more sound a little bit better than what they were
06:27 - 06:28
x amount of time ago.
06:28 - 06:31
What we have here is the National Labor Relations Act
06:31 - 06:34
Relations Act, which allowed workers to unionize.
06:35 - 06:36
And we cannot terminate.
06:37 - 06:39
We cannot discipline based on the status of this.
06:40 - 06:42
So if you learn that one of your employees is
06:42 - 06:46
in fact a union member, you cannot terminate them based
06:46 - 06:46
on this purpose.
06:48 - 06:51
Secondly, we have the 1947 Taft Hartley revisions which input
06:52 - 06:53
protected employees from unions.
06:54 - 06:55
It makes individuals joining.
06:55 - 06:57
It's, um or no.
06:58 - 06:58
I'm sorry.
06:58 - 07:00
It did not allow individuals.
07:01 - 07:02
I'm sorry it made it so.
07:02 - 07:05
Individuals who did not want to join unions did not
07:05 - 07:05
have to.
07:06 - 07:08
It also made co versions from unions illegal.
07:09 - 07:12
Lastly, we have worn, which is the worker adjustment in
07:12 - 07:13
Restraining Notification Act.
07:14 - 07:16
Basically, all this is is that if we choose to
07:16 - 07:20
move locations or outsourced to a different country, we have
07:20 - 07:22
to give the employees 60 day notice.
07:23 - 07:25
This allows families and their workers to make sure that
07:25 - 07:28
they are sound and that they will also get different
07:28 - 07:32
positions and live their livelihood thes air citations from both
07:32 - 07:33
of my slides here.
07:34 - 07:36
Or I should say, all four, my slides and the
07:36 - 07:37
main take home message.
07:37 - 07:39
But I want to give to you guys is making
07:39 - 07:42
sure that if the scenario does come up like this
07:42 - 07:45
and you have questions, too, don't hesitate to ask someone.
07:45 - 07:48
In upper management, these kind of situations can ask a
07:48 - 07:51
late rather quickly and without the assistance of upper management
07:52 - 07:54
and another set of eyes on the scenario, things can
07:54 - 07:56
get pretty bad pretty fast.
07:57 - 08:00
So to avoid legal run ins with employees, consumers and
08:01 - 08:04
employers, please just ask if you have any questions.
08:05 - 08:05
Thank you so much.
08:06 - 08:06
Have a good one
