Transcript of 5th Amendment

There were many people involved in the making of the Bill of Rights. The founding fathers all helped in the making of the Fifth Amendment, but James Madison proposed the idea. George Mason penned it.

It's Purpose

The Fifth Amendment was created because the Founding Fathers wanted to protect rights of the people that were accused. The Fifth Amendment helps us from unfair prosecution and investigation.
When?
The Fifth Amendment was:

Proposed on Sept 25, 1789

Ratified on Dec 15, 1791

Happened in Philadelphia,
Pensilvaia
Oliver North

Pleading the Fifth
Casey Anthony was brought to trial against Zenaida Gonzalez. Anthony reported this woman kidnapped her baby. Gonzalez was suing Anthony because of the accusation. Anthony said numerous lies and when asked about them she pleaded the Fifth.
Later they found out Anthony killed her own baby.
This Amendment also makes it so that the government can not take your private land away from you unless they fairly pay you for it.

What is the Fifth Amendment?

Most people think that that Fifth Amendment is just the right to remain silent. It is actually also the right to a grand jury trial, and the right to not be tried twice for the same crime.
George Mason once said
" In all capital or criminal prosecutions a man hath a right to demand the cause and nature of his accusation. nor can he be compelled to give evidence against himself.

This is why they made the 5th. So people didnt have to testify against themselves.
One of the most famous usage of the fifth amendment was when Oliver North pleaded the fifth during congressional inquires in the Iran scandals. He later said he would testify if they promised him ammunity. He was later found guilty but wasn't charged because he had ammunity.
5th Amendment:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
I think that the 5th Amendment was a good idea. I dont think people should be able to have their land just taken from them with no payment. I also think that people should not have to testify against them self in court.
