Criminal Code definition:
279. (1) Every person commits an offence who kidnaps a person with intent
(a) to cause the person to be confined or imprisoned against the person’s will;

Kidnapping
Parties to the offence:
Principal Offender: Mother Gothel
Actus Reus:
Mother Gothel breaks into the castle and kidnaps Rapunzel from her parents, the King and Queen.
Mens Rea:
She needs Rapunzel’s hair to stay young; once it’s cut off it turns brown and loses it’s power, so she has no choice but to take the baby.
Penalty:
Indictable Offence - Imprisonment for life
(Rapunzel was under 16 years of age and was taken by someone other than a parent, guardian or someone having the lawful care or charge of the person)
Forcible Confinement
Criminal Code definition:
279. (2) Every one who, without lawful authority, confines, imprisons or forcibly seizes another person is guilty of
(a) an indictable offence and liable to imprisonment for a term not exceeding ten years; or

While trying to catch Flynn and Rapunzel, Max stomped on the platform causing the walls to fall and a flood to break out - a wave of water strikes the guards and others (endangering their lives).

: The guards were after them in hot pursuit and they needed to get away

Under the Criminal Code of Canada, Section 279, 1 A, the defendant, Mother Gothel, is guilty of kidnapping one Princess Rapunzel.
The Honourable Justice Cooligan
finds that the defendant did on September 14, 2014 commit theft namely by unlawfully removing and possessing property owned by the King & Queen of Corona namely the Lost Princess' crown. Based on the evidence heard, including the testimony of the royal guard, under section 322 1 A of the Criminal Code of Canada, the defendant, Flynn Ryder, is guilty of theft and will be sentenced to 10 years in prison.
