Role in Government
I am the honorable Ramona Salvarez, I am a Federal Circut Judge and have been a judge for 19 years. I don't differ too much from any other elected official, other than I was appointed by a Democratic President. Some other judges can be appointed by governors as well.
How my role as an official is the same
My role as an elected official is the same as others, by the following. We are all elected and appointed by respected authorities. Also, we all have the same of interests of government.
Should judges be elected?
Yes, I believe they should. Since many appointed officials have been in government for a while, they know what they are doing. If they are being elected or appointed, its for a reason. Therefore, yes they should.
What is Judicial Review?
Judicial Review is when appointed judges are given the power to review or deny laws or acts if they believe it is unconstitutional. That is also why you cannot appoint any person, you need to appoint someone who knows how all the laws work and are an actual judge.
Role of Judicial Review in Recent Case
The recent case states that a music websites was automatically charging membership fees, soon after the free trial ended. Which automatically violated the consumer rights in some states. Citizens from one state brought that to court but the information was based off of a different state. Although, the website stated it when you sign up for a free trial, it is also tiny and unclear to the member. Making it not fair for the member and the company making money. Judicial review has a role in this case since it might not apply to any law or act. So that can be denied
Although there are many factors to keep in consideration, such as its the fault the members signing up didn't read it. Also, the music company is at fault, since they refused to make it clear and noticeable. With keeping all these things in mind, I still believe the members should get there money back. But they should be aware for the future for other companies.
