Federal Labor Standards Act The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, recordkeeping, and child labor laws that affect employees and their employers. $7.31 Basic Wage Standards FLSA requires that deductions made from an employee's wages for required uniforms, tools of the trade, or purchases made for merchandise shortages cannot reduce the employee's wage rate below the established minimum wage. Some examples of what FLSA does not require are:

vacation, holiday, severance, or sick pay
paid meal or paid rest periods
premium pay for weekend or holiday work
pay raises or fringe benefits Who is Covered? All Employees at FGCU are covered by FLSA. Employer-Furnished Facilities Resident Assistants •~Prohibited from most nonfarm work
•~May be employed by parents, except in hazardous industries, manufacturing, or mining
~Certain jobs permitted (for example/ actors, newspaper carrier, radio) Under Age 14 ~During school hours, cannot work more than three hours/day, 18 hours/week
~During school vacations, cannot work more than eight hours/day, 40 hours/week
~Hours restricted to 7:00 am to 7:00 pm (9:00 pm from June 1st to Labor Day) Ages 14-15 Ages 16-17 •~Prohibited from working on hazardous jobs such as mining or manufacturing

Includes FGCU's Policy Time Sheet Certification Employers are required to provide reasonable break time for an employee to express breast milk for her nursing child for one year after the child’s birth each time such employee has need to express the milk. Employers are also required to provide a place that is shielded from view and free from intrusion from coworkers and the public. Bathroom Overtime Nonexempt workers must be paid no less than one and one half times their regular rate of pay after 40 hours OF WORK in a work week. $368.00 Enforcement Benefit earning employees must be kept for 25 years.
OPS employees must be kept for 5 years. This is seperate from payroll information which has a different retention schedule. I HEREBY CERTIFY THIS IS A TRUE AND ACCURATE RECORD OF ALL HOURS WORKED AND LEAVE TAKEN DURING THIS PAY PERIOD. FALSIFICATION OF ATTENDANCE AND LEAVE RECORDS IS A VIOLATION OF UNIVERSITY REGULATION AND MAY SUBJECT THE EMPLOYEE AND SUPERVISOR TO DISCIPLINARY ACTION UP TO DISMISSAL. Salary Basis Test
The Duties Test OPS employees and the majority of SP are nonexempt. Nonexempt employees are entitled to a special pay rate for overtime hours. Are faculty exempt or nonexempt? There are around 1,000 exempt employees at FGCU including adjuncts. Computing Overtime Wage and Hours Division WHD’s agents conduct investigations and gather data on wages, hours, and other employment conditions or practices, in order to determine compliance with the law.
