Act of 1994 Section 8 - Powers and Functions of Commission The commission shall have the following functions:
formulate and recommend
monitor and evaluate
devise and implement
promulgate and exercise
perform Section 10 - The Higher Education Department Fund the fund established for the strengthening of higher education in the entire country
a. government contribution
- 500,000,000 as seed capital
- 50,000,000 for the initial operation
- 40% annual share on the total gross collections of the travel tax
- 30% from the Professional Registration Fee
- 1% of the gross sales of the lotto operation of the PCSO
b. private portion Commission

No. 7722 Section 1 The act shall be known as the Section 3 - Creation of the CHED The CHED shall be:
* independent and separate from DECS
* attached from the office of the president for administrative purposes only

Commissioner = Undersecretary Section 6 - Board of Advisers Board of Advisers DECS Secretary Dir-Gen of NEDA Secretaries of DOST, DTI, DOLE FAAP and FAPE chairman commissioner additional Section 9 - The Secretariat The commission shall organize a secretariat headed by an executive officer
fixes the staffing pattern
determines the duties, responsibilities and functions for the different positions
determines compensation scheme
prepares budget and approve its budget Section 11 - Management and Administration of the Higher Education Development Fund the fund shall be administered by the commission
for the sound and judicious management of the fund, the commission shall appoint a reputable gov't financial institution as potfolio manager of the fund
fund shall be utilized equitably according to regions and programs
Section 12 - The Technical Panels the commission shall organize technical panels (senior specialists/ academicians) for different disciplines/program areas Section 13 - Guarantee of Academic Freedom Section 14 - Accreditation the commission shall provide incentives to institutions of higher learning, public and private, whose programs are accredited. Section 15 - Tax Exemptions Any donation, contribution, bequest, and grant which may be made to commission shall be exempt from tax, subject to such conditions as provided under the National Internal Revenue Code Section 16 - Authority The commission shall exercise such authority as may be deemed necessary within its premises or areas of operation to effectively carry out its powers and functions, and to attain its objectives. Section 17 - Appropriation the amount of 500,000,000 is appropriated as seed capital of the fund
additional amount of 50,000,000 is appropriated out of the funds in the National Treasury, from the Philippine Amusement and Gaming Corporation (PAGCOR)
<The funds necessary shall be included in the General Appropriateness Activity> Section 18 - Transitory Provisions such personnel, properties, assets and liabilities, functions and responsibilities of gov't entities having functions similar to those of the commission all hereby transferred to the commission
the commission shall have the authority to appoint its own personnel
all regular employees transferred to the commission shall not suffer any loss of seniority or decrease in emoluments. All laws, presidential decrees, executive orders, rules and regulations or parts thereof which are inconsistent with the provisions of this Act are hereby repealed or modified accordingly. Section 19 - Repealing Clause Section 20 - Separability Clause if any part of this act shall be held unconstitutional, other provisions hereof which are not affected thereby shall continue to be in full force and effect. Section 21 - Effectivity This act shall take effect upon its approval.
