Do you know what Sharia law is? What parts of life does Sharia govern? How to Move Forward Sources of Sharia Sharia in the United States In the US, sharia law is only allowed in matters involving marriage contracts, commercial agreements, or probating an Islamic will. U.S. courts apply Islamic law while interpreting foreign law in commercial disputes between litigants from different nations, or custody agreements negotiated in another country. A similar process is used when dealing with any other foreign law or Catholic canon law. For the most part, American Muslims tend to view sharia as a private system of morality and identity utilized in issues of marriage and divorce. Quran Sunna How Sharia is Perceived in the
United States The American Public’s perception of Muslims is more negative than Judaism, Christianity, and Buddhism As of February 7th, 2012, twenty-one states, including New Hampshire, were considering legislation that would forbid judges from applying the legal codes of other nations in cases of law in the United States. Tennessee, Louisiana and Arizona recently passed laws that prohibit judges from applying foreign legal codes to court cases in the US. Oklahoma amended its state constitution to include a similar provision two years ago. Republican Presidential Candidate and Former Speaker of the House Newt Gingrich has been a very vocal critic of sharia Fatwas Analogy Presidential Candidate Mitt Romney has been quoted as saying: “Well, first of all, of course, we're not going to have Sharia law applied in U.S. courts. That's never going to happen. We have a Constitution and we follow the law.” Members of the Obama administration feel that sharia has been misunderstood in the United States and that much of the prejudice comes from a lack of understanding.
