“Given that access to information concerning the functioning of all levels of government is critical for democratic participation;
Given that the “open court” principle means that all members of the public should have the opportunity to attend, observe, and comment on court proceedings;
Given that the ability to actually observe what happens during court proceedings is currently limited to the few who can physically attend inside the courtroom; and.
Given that in this modern age much information is now obtained through electronic and digital means and that the average person has become dependent upon these conduits of communication;
Therefore, be it resolved that it is now time for television cameras to be permitted to record and broadcast court proceedings in all cases, except that the trial judge shall have a discretion to ensure that the identity of certain persons such as victims of sexual assault, incest, child abuse, and like crimes, shall not be broadcast or otherwise disclosed.”
