Tyranny of the Majority

-Increased law and power of legislature puts all the authority in the Government.

-Gives strength to the strong, and enforces weakness in the weak.

  • 1% v 99% (is this a majority?)

-Juries represent the majority in state of law.

  • Are juries a good representation of the public opinion?
  • What if it is a highly controvercial case?
  • A Time To Kill- controvercial case where the State is divided in deciding the outcome of a criminal due to his race. How does the jury decide who to represent?

-Democracy in the United States of America

-Legislature (elected members) represent the people in decisions regarding legal and political matters.

-Public Majority regards the opinions of the masses v. the few.

-A government (authority) can not be a majority because a minority can not pull the majority to their side without forfeiting the differences between them. Which is the original problem.

-Public opinion can have a mobbing affect when the masses have a shared motivation.
