9th Amendment

The 9th amendment states that citizens of the U.S. have rights not listed in the Constitution. Just because certain rights are not listed does not mean that they are not provided to the people. A right in Madison Heights that is not listed in the Constitution is that families get to chose what school district in Oakland County to send their children to. The picture below shows all the schools a part of this school of choice program, including two Madison Heights schools, Lamphere and Madison.

5th Amendment

If someone is accused of a crime then they have certain rights. There must be a reasonable amount of evidence before a trial can even take place. This is shown in the article when it states that in the investigations they are currently working on there is a couple pieces of evidence they are using as leads. They are not going to court because there is not enough evidnece as of right now. Other rights include that an accused person must know his miranda rights and they cannot be charged for the same crime twice. The paragraph from our student handbook shows that a student must know what they are accused of (one of the Miranda rights) and they also will have a meeting with members of the administration then if they wish they can have an appeal with other members (no double jeopardy).

11th Amendment

The 11th amendment was ratified to make sure that state courts still had some power along with the federal courts. This amendment states that if someone sues a state then that case is to be tried in that state. This article in our local paper states that a couple from Hazel Park is trying to sue Michigan for their gay rights stance and child adoption laws. This article also states that this case was heard in Eastern District of Michigan's court with Rick Snyder and Schutte defending Michigan.

2nd Amendment

4th Amendment

This amendment was written in order to protect an individual during a search and seizure. There may only be a seach if a judge finds a reasonable cause for one. This page from our student handbook says that because the lockers and parking lot are school property and the school has reason to believe you are in possession of an illegal substance then they can commit a search. These correlate because in the school setting search the school acts as the judge and there still has to be reasonable proof towards thinking that you are in possession.

The 2nd amendment is the amendment dedicated to giving citizens the right to bear arms. This video and picture taken from Double Action located on 32411 Dequindre Road, Madison Heights shows that citizens have the freedom to exercise their gun rights by practicing their shooting and they can take classes here to earn their licenses.
