Double jeopardy means you cannot be tried in the court system twice for the same crime.

Three main levels:

  • District Courts
  • Circuit Courts
  • Supreme Court of the United States

* There are 94 district courts, 13 circuit courts, and one supreme court in the U.S.

Judicial System

Federal judges and supreme court justices are selected by the President and confirmed by Senate, for life.

Three major institutions:

  • Police- investigation of crime
  • The court - determination of verdict, guilty or not
  • The punishment - mostly incarceration or probation
  • Federal Courts have limited jurisdiction meaning they are only allowed to hear certain cases, including federal laws and issues regarding the constitution.
  • If a law is broken and overlaps between state law and federal law, the case can be heard in either court.
  • Diversity Jurisdiction - Special Circumstances
