The Endangered Species Act has allowed federal funding for research to find a cure for the deadly chytrid fungus and to save elevated streams and wetland habitats from pollution and poorly managed recreation and livestock overgrazing.
To gain Federal protection of the imperiled species, the Rocky Mountain Wild and Biodiversity Conservation centers have issued petitions to address the boreal toad species as "endangered" and they wanted to address the drastic decline of the toad population and the forces that are destroying them and their habitat. The 90-day finding was used to allow periods of scientific research in showing evidence that these toads are experiencing significant declines in population size and distribution
Regulated by the government and the state itself, created a framework that governs the construction of buildings over 40 ft high within a 100 vertical feet from the crest of the Little Sugar Mountain Ridge of Avery County. Nearby cities and counties were offered 3 options under the act which included total prohibition of construction, a flexible permit system, or opting out of the act.
