The Copyright (Computer Programs) Regulations (1992)

8 Principles

Extends the Copyright, Designs & Patents act.

It ensures that computer programs are covered under copyright.

Copyright, Designs & Patents Act (1988)

1 Personal data shall be processed fairly

and lawfully.

2 Personal data shall be obtained for

limited, specifically stated purposes.

3 Personal data shall be adequate,

relevant and not excessive.

4 Personal data shall be accurate and,

where necessary, kept up to date.

Data Protection Act (1998)

Protects the creators of original works by giving them the right to control how these original works are used.

The punishment is usually limited to paying damages to the copyright holder as well as handing over any profits.

It can involve a 10 year jail sentence though.

Protects the privacy of individuals by ensuring that their personal information is processed in an ethical manner.

This can be punished by a fine of up to £500,000.

5 Personal data shall be kept for no

longer than is absolutely necessary.

6 Personal data shall be processed

according to peoples data protection

rights.

7 Personal data shall be kept safe and

secure.

8 Personal data shall not be transferred

outside the European Economic Area

without adequate protection.

The Health and Safety (Display Screen Equipment) Regulations (1992)

Data & User Protection Legislation

Extended the Health & Safety at Work Act.

Ensures that display equipment must comply with health and safety regs.

Failure to comply with these regulations is normally punished through a fine.

Computer Misuse Act Punishments

Each offence in the CMA has a different level of punishment.

Offence 1 - up to 2 years in prison and/or a

large fine.

Offence 2 - up to 5 years in prison and/or a

large fine.

Offence 3 - up to 10 years in prison and/or

a large fine.

Computer Misuse Act (1990)

Police and Justice Act (Computer Misuse) (2006)

Protects users against the theft & damage of the info they store on IT systems.

It covered 3 offences:

1 Unauthorised access to computer material.

2 Unauthorised access with intent to commit

or facilitate further offences.

3 Unauthorised acts with intent to impair, or

with recklessness as to impairing,

operation of computer.

Extended the Computer Misuse Act.

Offence 1 punishment increased to 2 years and offence 3 covers DoS attacks.

Also added an additional offence:

3a Making, supplying or obtaining anything

which can be used in computer misuse

offences. Punished by up to 2 years in

prison and/or a large fine.

Consumer Rights Act (2015)

Defines the rights and remedies of consumers, whether that be consumers of goods, services or digital content.

Before the consumer rights act, there was no protection for consumers of digital content.

If a business refuses to comply with the legislation then a consumer can take them to court to claim compensation.
