Hello everyone.
- 00:01 - 00:04
My name is bailey, gorgeous, and this presentation is over
- 00:04 - 00:08
the conflict of dress codes for module 31 issue of
- 00:09 - 00:09
conflicting rights.
- 00:11 - 00:15
Okay, so this presentation is going to cover a situation
- 00:15 - 00:17
that I personally had experienced.
- 00:18 - 00:20
Um it was not me, that was the student that
- 00:21 - 00:22
had to experience this.
- 00:22 - 00:24
This was something that happened while I was a student
- 00:24 - 00:26
that has always stuck with me and I thought would
- 00:26 - 00:28
be a really important thing to discuss in my presentation.
- 00:30 - 00:34
Let's go ahead and cover the question question that I
- 00:34 - 00:37
have, who does the dress code actually support?
- 00:38 - 00:41
Okay, in this situation there was a female student who
- 00:41 - 00:45
was wearing a sweatshirt and um Nike athletic shorts.
- 00:46 - 00:49
The Nike athletic shorts were shorter than the dress code,
- 00:49 - 00:51
but this hadn't been a problem until some male students
- 00:52 - 00:55
were actually making inappropriate comments about the student.
- 00:55 - 00:59
The teacher overheard these inappropriate comments and decided to pull
- 01:00 - 01:03
the student, the female student out of the classroom and
- 01:03 - 01:06
dress coded her and sent her to the principal.
- 01:07 - 01:12
The principal then punished her for violating the dress code
- 01:12 - 01:13
In in that situation.
- 01:14 - 01:16
All she had to do was be sent home and
- 01:17 - 01:20
the next day just make sure that she was wearing
- 01:20 - 01:20
appropriate clothing.
- 01:21 - 01:24
So this leads to the question of who does the
- 01:24 - 01:25
dress code actually support?
- 01:26 - 01:30
Yeah. Now we're going to cover the arguments here as
- 01:30 - 01:31
to what the issue is.
- 01:32 - 01:34
Here's the argument between the student and the school.
- 01:34 - 01:35
We will start with the school first.
- 01:37 - 01:40
Okay. The school's argument is that it was very clear
- 01:40 - 01:41
the student broke the dress code.
- 01:42 - 01:43
There is set rules in place for a dress code.
- 01:44 - 01:45
The student broke them.
- 01:46 - 01:48
In addition, dress codes are set in place for many
- 01:48 - 01:53
reasons onto the students argument.
- 01:54 - 01:56
Students argument is that her outfit was not an issue
- 01:56 - 02:01
until male students made inappropriate comments and nothing will be
- 02:01 - 02:05
done about the comments that were made about the female
- 02:05 - 02:06
student wearing the shorts.
- 02:08 - 02:10
Yeah, yeah.
- 02:12 - 02:13
Okay. Some analysis of this situation.
- 02:14 - 02:17
Um, first of all with rights title nine does not
- 02:18 - 02:19
allow dress codes to be discriminatory.
- 02:21 - 02:25
However, while this dress code was not discriminatory, what happened
- 02:25 - 02:30
to the student was discriminatory because the fact that inappropriate
- 02:30 - 02:34
comments were made towards her about what she was wearing,
- 02:35 - 02:36
that made her feel uncomfortable.
- 02:36 - 02:39
But yet nothing was done about those comments and she
- 02:40 - 02:40
was the one that was punished.
- 02:41 - 02:44
And then this Tyson also, with the First Amendment to
- 02:44 - 02:47
the First Amendment, allows for freedom of speech and freedom
- 02:47 - 02:47
of religion.
- 02:48 - 02:51
Freedom of speech then turns into freedom of expression and
- 02:52 - 02:55
freedom of expression can turn into clothing choice.
- 02:56 - 02:58
They're all tied in together and it's kind of a
- 02:58 - 03:02
fine grey area as for personal ethical beliefs.
- 03:03 - 03:06
Um, I do see as a teacher where the student
- 03:07 - 03:09
broke the dress code, which was a rule that was
- 03:09 - 03:11
set in place, but also it's highly concerning that nothing
- 03:12 - 03:14
was ever done to the male students that were making
- 03:14 - 03:15
inappropriate comments.
- 03:15 - 03:18
It leaves me to have to wonder what about the
- 03:19 - 03:20
females education?
- 03:21 - 03:23
Wasn't her education important as well.
- 03:23 - 03:25
If she was highly uncomfortable with the comments that were
- 03:25 - 03:28
being made and a teacher heard them, why didn't the
- 03:28 - 03:30
teacher do anything about the male students as well?
- 03:32 - 03:35
Okay, lessons learned.
- 03:35 - 03:38
Um, so the conclusion of this particular situation that happened
- 03:39 - 03:42
was nothing, unfortunately, it just died out.
- 03:42 - 03:43
Nothing was ever really done about it.
- 03:44 - 03:47
But the questions remaining led me to think, who does
- 03:47 - 03:50
the dress code truly benefit in this situation of female
- 03:50 - 03:51
student was punished.
- 03:51 - 03:55
Her education was stopped for a whole day because of
- 03:55 - 03:55
what she was wearing.
- 03:56 - 03:59
And male students that made inappropriate comments about her were
- 03:59 - 04:00
punished in any way.
- 04:01 - 04:02
These are some serious things.
- 04:02 - 04:06
Why weren't they punished as well as somebody who is
- 04:06 - 04:06
in education.
- 04:07 - 04:09
Now, I do see where both people were in the
- 04:09 - 04:12
wrong, the student and the male students, but it still
- 04:13 - 04:14
does bother me that the males weren't punished.
- 04:17 - 04:19
Yeah, here are my references that I used to prepare
- 04:20 - 04:20
for this presentation.
- 04:21 - 04:22
Thank you very much for listening.
