What

How are these cases different?

Miranda was charged with rape and kidnap, while Vignera was charged with robbery. The sentences were different, Miranda was sentenced 40-60 years in prison, while Vignera was sentenced 30-60.

Vignera v. New York

What was the constitutional question and which part was involved?

-Vignera was picked up for a dress shop robbery that had occurred three days prior. He was taken to the 5th detective squad hq, then later the 66th detective squad, where he verbally admitted the robbery and was formally arrested. He was taken to the 70th precinct for detention and questioning and found guilty of robbery and sentenced 30 to 60 years in prison.

The constitutional question asked if the 5th amendment was violated, and involved the 5th amendment.

Miranda v. Arizona
