Miscarriage of Justice

  • On November 29, 2001, by section 690 of the Criminal Code, Truscott filed an application for a review of his murder conviction back in 1959.

  • Nearly 250 new pieces of evidence were reviewed, and on August 28, 2007, the Ontario Court of Appeal declared that Steven Truscott's conviction had been a miscarriage of justice

  • On July 7, 2008, he was a compensation of $6.5 million by the government of Ontario

  • No one has any notion as to who the actual killer was

Verdict and Sentence

  • The jury decided that Truscott was guilty, but gave a recommendation for mercy

  • Nevertheless, the judge was required by law to sentence Truscott to be hanged

  • His execution was scheduled for December 8, but a temporary reprieve on November 20 postponed his execution to February 16 to allow for an appeal.

  • On January 22, his death sentence was commuted to life imprisonment

The Trial

  • Truscott's trial began on September 16 in the Supreme Court of Canada
  • The defence had a difficult time, as Steven's account of Harper entering the unknown vehicle was practically their only lead.
  • The crown had a very good case, and all of the facts seemed to place Lynne Harper's death to within the short time that she was with Steven.

Arrest & Charges

  • Truscott was taken into custody on the evening of June 12, and was held in the Huron County Jail in Goderich for 3 months before his trial

  • The next morning, he was sentenced to first degree murder under provisions of the Juvenile Delinquents Act

  • On June 30, he was ordered to be tried as an adult, but the appeal on this order was dismissed

The Case

  • On June 9, 1959, 12-year-old Lynne Harper disappeared near RCAF Station Clinton, located just south of Clinton, Ontario

  • Her body was discovered two days later in the woodlot of a nearby farm. She had been raped and strangled to death with her own blouse

  • Steven Truscott, who was 14 years old at the time, was classmates with Harper, Air Vice Marshal Hugh Campbell School, which lies on the north side of Station Clinton

  • On the day of Harper's disappearance, Truscott claimed that he gave her a ride on the crossbar of his bicycle as they rode north from the school along the County Road. He has maintained since that day that he dropped Harper off at the intersection of the County Road and Highway 8, and looked back as he rode away to see her entering a vehicle that had stopped next to her.
