In 2000, Pepsi started an advertising campaign in which they gave out "Pepsi Points" which could be exchanged for "Pepsi Stuff"

One Pepsi Point was equal to 10 cents

In the commercials that Pepsico was making, a Harrier Jet was depicted as being worth 7,000,000 Pepsi Points.

Leonard managed to raise $700,000, or 7,000,000 Pepsi Points.

When Leonard filled out the Pepsi catalog, he checked off "Harrier Jet", and expected to receive his prize.

Pepsico returned Leonard's check, assuring that the Jet was only an exaggerated advertising technique

According to the Pepsi commercial, a t-shirt was worth 75 points, a leather jacket was 1450 points, sunglasses were 175 points, and a Harrier Jet was 7,000,000 points. Leonard stated that since the other three prizes were valid, the Jet should be as well.

"Pepsico apologized for any misunderstanding and informed Leonard that the commercial was intended to be humorous and entertaining."

Leonard then proceeded to sue Pepsico, demanding the Jet. The jury was asked to decide whether or not they thought that Leonard was reasonable in believing the possibility of getting the jet.

The jury decided that the possibility of actually getting the jet was nothing more than an exaggerated fantasy.

This made the offer unbelievable

This case is a strict liability case, seeing as Pepsico, a corporation is the one being sued.

Which also makes Pepsico the defendant in this case

Leonard was clearly the plaintiff.
