The Court decided that this did not violate the First Amendment because it was only displayed during the holiday season.

The Court voted against Newdow unanimously because he and the mother of his daughter were divorced and he did not have custody. This proves that the verdict is not purely decided by the event that took place, but also the circumstances and the important little details.

Lynch v. Donnelly (1984)

In Pawtucket, Rhode Island, there was a Christmas display including a nativity scene. The nativity scene had been included in the display for 40 years. Daniel Donnelly did not agree with this (because it was religious) and brought it up to the mayor of Pawtucket, Dennis Lynch.

Micheal Newdow's daughter attended a public school in the Elk Grove Unified School District in California. Every morning, the teachers at her school led the students in the Pledge of Allegiance. Of course , the pledge includes the words "under God". Micheal Newdow sued the school, arguing that, even if participance wasn't required, making the students listen violates the First Amendment. Keep in mind, Micheal Newdow and the mother of his daughter were divorced and he did not have custody.
