Intro

William stinchcombe was a lawyer in Alberta.

He was accused of misusing propert, breach of trust, theft and fraud.

Befrore trial Ms.Lineham, a secretary of stinchcombe was interviewed and a tape was recorded.

Stinchcombe was told about the tape but the info was not disclosed.

The first trial found him guilty and ms. lineham wasn't called as a witness and the tape was never revealed.

  • Alberta Court of Appeal: Uphelt the previous decision

  • SCC: Overturned the decision and asked for a new trial.

Stinchcombe appealed to the Allberta court of appeal which upheld the decision.

Appeal made to the scc where it was ruled that the trial was unfair and ordered a new trial.
