Termination and Discipline

Objective :

Understand that making tough decisions

and taking disciplinary action are part of

the human resources job description.

INTRO

When an employee fails to live up to expectations on the job, or if economic problems arise that lead to downsizing the company, somebody has to be the one designated to discipline employees and terminate

employees' contracts.

Legally?

Legally, a dismissal must be documented as to the reason and in some cases must show

that the employee has been informed of the deficiency and given a chance and assistance

to improve prior to being fired.

Laws are specific about factors that may not be used as

reason for termination.

There are unions that support employees and ethical values that should prevent companies from firing people without a good reason.

It is imperative that HR personnel review each case with company lawyers before they fire an employee.

Sometimes personal problems between employees occur and affect the job.

Discipline should be imposed fairly and consistently and should be appropriate considering the infraction.

If contract cancellation is considered, decision makers should decide the termination based on a thorough and fair investigation.

Results of the investigation should be available for review by the employees involved.

HR must hear an appeal if someone thinks the decision is unfair. In case of an appeal, HR would be the unbiased party to make the final decision based on the facts and guided by the company's rules and regulations, not personal opinion.

The Group is a big retail company with over 700 employees.The Group owns and operates Cozmo, a supermarket chain. They also operate well-known franchises like Hamleys for toys, BHS for clothes, and Readers for books.

Explain

Noor Fakhouri, HR manager at The Group thinks that working in the retail industry requires you to be innovative and active.

Because the retail industry has a high job turnover among the front line

jobs.

This turnover is due to the fact that most front-liners are part-time college students who take these job as a temporary income source to cover basic needs while attending school.

She thinks this is understandable, but also believes that this turnover may affect the business negatively if taken lightly.

Why does having a great turnover places a big responsibility of the HR staff?

Because new employees need a lot of training & the HR department must ensure that all employees understand the mission and the vision of the organization and fulfill what is expected of them in terms of customer service.
