What is the 1st Amendment?

1st Amendment

The 1st Amendment is part of the US Bill of Rights. It gives people the right to 5 freedoms. Those 5 freedoms are:

Freedom of Speech

the right to express any opinions without censorship or restraint.

Freedom of religion is a principle that supports the freedom of an individual or community, in public or private, to manifest religion or belief in teaching, practice, worship, and observance without government influence or intervention

Freedom of Press

PRESS

Freedom of the press or freedom of the media is the principle that communication and expression through various media, including printed and electronic media, especially published materials, should be considered a right to be exercised freely

Freedom of Assembly

ASSEMBLY

Freedom of assembly is the individual right or ability of people to come together and collectively express, promote, pursue, and defend their collective or shared ideas

PETITION

The right to petition government for redress of grievances is the right to make a complaint to, or seek the assistance of, one's government, without fear of punishment or reprisals

What is the 4th Amendment?

The 4th Amendment is the right to be secure and private and prohibits unreasonable searches and seizures without a warrant.

4th Amendment

EXAMPLE

An arrest is found to violate the Fourth Amendment because it was not supported by probable cause or a valid warrant. Any evidence obtained through that unlawful arrest, such as a confession, will be kept out of the case.

• Supported by oath/affirmation

• Must describe the place to be searched specifically

• Identify what is being looked for

What is the 5th Amendment?

5th Amendment

The 5th Amendment is the right to remain silent. It imposes restrictions on the governments prosecution of the persons accused of crimes. It prohibits self-incrimination and double jeopardy and mandates due process of law. It is based on the court case and ruling of Miranda v Arizona.

What is due process?

Due process is the right to life, liberty, and property.

Miranda v. Arizona

In Miranda v. Arizona (1966), the Supreme Court ruled that detained criminal suspects, prior to police questioning, must be informed of their constitutional right to an attorney and against self-incrimination.

Ruling: 5-4 majority in favor of Miranda

What are the Reconstruction Amendments?

Reconstruction Amendments

The Reconstruction Amendments are the 13th, 14th, and 15th Amendments. What they do is:

  • Abolish Slavery
  • Make African Americans citizens
  • the right to vote is not discriminated upon by race
