How Do We Define FosterCare?
Office of Head Start, Adminstration for Children and Families, & the Department of Heath and Human Services.
Foster care means 24-hour substitute care for children placed away from their parents or guardians and for whom the state agency has placement and care responsibility. This includes, but is not limited to, placements in foster family homes, foster homes of relatives, group homes, emergency shelters, residential facilities, child care institutions, and pre-adoptive homes. A child is in foster care in accordance with this definition regardless of whether the foster care facility is licensed and payments are made by the state or local agency for the care of the child, whether adoption subsidy payments are being made prior to the finalization of an adoption, or whether there is Federal matching of any payments that are made.
Foster Care
Foster home care is a safe, temporary placement providing 24-hour-a-day substitute care for children in Oklahoma Department of Human Services custody. Thousands of children each year are placed by the court, for various reasons, in the custody of OKDHS. The children range in age from birth to 18 years and are all races, cultures and religions. Many times the children are in sibling groups needing to be placed together. Some of the children are physically, mentally or emotionally challenged. A child may have suffered from physical abuse, sexual abuse, mental abuse or severe neglect by a person who is responsible for the child. The child’s parents may have been arrested and put in jail. Whatever the circumstances, each child has a story. Each child has many strengths and also many needs. They all need a safe, temporary place to live and tender loving care until they can return home or move to a permanent placement.
Guardianship
The court may establish a permanent guardianship between a child and a relative or other adult per Sections Sections 1-4-709 and 1-4-710 of Title 10A of the Oklahoma Statutes (10A O.S. §§ 1-4-709 and 1-4-710) when the guardianship is in the child's best interests and when all conditions listed in 10A O.S. § 1-4-709 are substantially satisfied.

State By OKDHS
The child who is unable to protect himself or herself due to his or her age, physical or emotional development, mobility, size, dependence, or inability to communicate needs.
(1) The child 5 years of age or younger is considered to have a high level of vulnerability as is the child with issues, such as disabilities, past victimization, or hazardous surroundings.
(2) The vulnerable child is susceptible to, and within access of, a threatening parent or caregiver.
