What is it?

Definition

Due process is the legal requirement that the government must respect all legal rights that are owed to a person.

"Innocent until proven guilty"

4th Amendment

World War II, also known as the Second World War, was a global war that lasted

4th Amendment

States that you are protected from unreasonable searches and seizures.

That means that the police need to have a valid reason to search or take your private property.

This is usually done in the form of a search warrant or probable cause.

5th Amendment

  • Double Jeopardy - no person can be put on trial for the same crime twice
  • Plead the 5th - you do not have to admit to or say anything that would prove you committed a crime
  • The government cannot take your property without paying you for it.

6th and 7th Amendments

6th and 7th Amendment

The 6th Amendment guarantees that if you are accused of crime you have:

  • The right to a speedy trial (you can be held in jail for 10 years before your trial)
  • The right to have a lawyer (even if you can afford one)

The 7th Amendment guarantees that you have the right to a trial by jury. A group of average citizens will decide if you are guilty or not.
