What is Sexual Assault?

What is Sexual Assault?

  • Sexual Assault is one form of sexual violence
  • It is a crime
  • It is defined by the Queen’s Sexual Violence Policy as:

Any form of sexual contact without mutual consent. Sexual assault includes unwanted kissing, fondling, touching, oral or anal sex, vaginal intercourse or other forms of penetration, or any unwanted act of a sexual nature that is imposed by one person onto another without consent.

  • Is the voluntary agreement to engage in sexual activity, at every instance.
  • Must be actively and willingly given
  • Can be withdrawn at any time

  • Is never assumed or implied Is not silence or the absence of no
  • Can not be given if the person is impaired by alcohol or drugs
  • Can not be given if the person is unconscious
  • Can never be obtained through threats or coercion
  • Can not be obtained if perpetrator abuses position of power, trust or authority

  • Confidentiality is essential in making sure that students feel comfortable disclosing or reporting sexual violence
  • Thereby allowing them to seek support and accommodations
  • It’s important that confidentiality of all those involved is maintained to the extent possible

Limits to Confidentiality

Limits to Confidentiality

  • An individual may be at risk of self-harm
  • An individual may pose a threat or risk to a Student who has Disclosed or Reported having been affected by Sexual Violence
  • An individual may pose a threat or risk to other members of the Queen’s Community or the broader community
  • Reporting is required by law (e.g. where a Disclosure or Report involves a minor)
  • The University has an obligation to investigate the allegation of Sexual Violence

  • There are other instances where information may be shared among staff and faculty in the university in order to facilitate requests for accommodations, support and/or reports
