Miranda V. Arizona

Ester Mercado

Case overview

Case overview

Ernesto Miranda was arrested after the police suspected him of kidnapping and raping a 18 year old women, but while Miranda was in custody the police didn’t remind him of his rights and didn’t tell him that he had the right to an attorney. The police brought Ernesto into the investigation room and he admitted to everything because he didn't have an attorney in the room with him, and while you’re being investigated an attorney is supposed to be present in the investigation room also Ernesto didn’t plead the fifth because the police didn’t tell him that he could, so Ernesto was clueless.

Ernesto Miranda

Constitutional Question

Constitutional Question

The case went to the supreme court because Miranda had made an appeal to them because of the fact that the police had unconstitutionally obtained his confession. The court agreed to hear Miranda’s appeal because the police didn’t first inform Miranda of his right to an attorney and his right to remain silent.

Courts decision

Court decision

The court's decision was a majority of 5-4, The court decided this because the police did not inform the suspect of his right to remain silent and his right to an attorney. The concurring opinion is that Chief Justice Earl Warren concluded by saying that the defendant's interrogation violated the Fifth Amendment, so the court reasoned with this information to protect the privilege. and the concurring opinion is saying that the police should have told the defendant before the investigation that he had the right to remain silent and that anything he said can be used against him in a court of law, and that the defendant was supposed to be told that he also had the right to an attorney.

Objectives

Significance

Significance

The impact of Miranda v. Arizona case in America is that now every time a police officer arrests a suspect they have to revise their rights to them while or before they are being arrested and questioned. Even though what Miranda did was wrong, he only admitted to everything because of the fact that the police didn’t remind him of his rights to remain silent and to an attorney, if he knew this information things would have been different but he would have still been investigated.
