CONTRATO
ES AQUEL QUE SE UTILIZA PARA SUSTITUIR A UN TRABAJADOR DE LA EMPRESA TEMPORALMENTE , CUYO VINCULO LABORAL SE ENCUENTRA SUSPENDIDO POR UNA CAUSA PREVISTA EN LA LEGISLACIÓN LABORAL. EL EMPLEADOR DEBERA RESERVAR EL PUESTO A SU TITULAR QUIEN CONSERVA SU DERECHO DE READMISIÓN EN LA EMPRESA , OPERANDO CON SU REINCORPORACIÓN EL CONTRATO SE EXTINGUE.

OBSERVACIÓN
- El contrato tiene que ser escrito,no puede ser verbal.
- La duracion del contrato es relativa (lo que demore en restablecerse el trabajador principal a su puesto.

Dicha modalidad de contrato esta sustentado en base al articulo 61 del Decreto Legislativo 728
LO QUE NO DEBE PASAR
ERRORES
Los errores mas frecuentes son:
- La renovación del suplente cuando el trabajador titular se reincorpora.
- Que el trabajador suplente realizé otra actividad que no sea la del trabajador titular.
- Que el suplente continué laborando después de la fecha de vencimiento del contrato.
SUCEDE CUANDO:
DESNATURALIZACIÓN
- Cuando el contrato dura más de 5 años.
- Cuando el contrato no es escrito.
- Cuando el suplente no desempeña el puesto y funciones que corresponden al trabajador titular .
