A report by the UN Human Rights office points out that people with mental health conditions and those with psychosocial disabilities experience disproportionately higher rates of poor physical health; have a reduced life expectancy – a 20-year drop for men and 15 years for women - compared with the general population.
In cases where extreme violations of human rights have occurred, reconciliation and peace building become much more difficult.
The right to physical and mental health is a broad concept that can be broken down into more specific entitlements such as the rights to:
maternal, child and reproductive health;
informed consent, bodily integrity and freedom from torture, ill-treatment and harmful practices;
healthy natural and workplace environments;
the prevention, treatment and control of diseases, including access to essential medicines;
and access to safe and potable water.
Employee dismissed from dream career due to mental health
in July 2018, John secured his dream role in the emergency services. He progressed exceptionally well throughout his training. But in April 2019, he was signed off work as his mental health had deteriorated following two family bereavements and the stress of a frontline role.
In the case of Cheltenham Borough Council v Christine Susan Laird [2009] the council sued its former employee for failure to disclose mental problems in a pre-employment questionnaire.
"The right to health contains both freedoms and entitlements. Freedoms include the right to control one's health, including the right to be free from non-consensual medical treatment and experimentation. Entitlements include the right to a system of health protection (i.e. health care and the underlying social determinants of health) that provides equality of opportunity for people to enjoy the highest attainable standard of health."
