Adnan Syed is Innocent

Brooks period 2

by Lauren Scacco

May 2018

Bad Lawyer

In the original trial, Adnan was represented by Cristina Gutierrez, a lawyer who was vastly well known for her groundbreaking work in high profile murder cases. Despite her fantastic reputation, Gutirrez severely mismanaged the trial of Adnan Syed. A year after the trial of Adnan, she was disbarred for mismanaging the funds

of her clients. In addition to this, her behavior leading up, during, and immediately following the trial was repeatedly considered to be unusual. She also disregarded massive pieces of evidence that might of dramatically changed the outcome of Adnan's trials. Again, this is placeholder text to fill the blank space and make this newspaper look more realistic, but some of this might be used within the actual content of this presentation.

Jay's Inconsistencies

Jay has many inconsistencies in each testimony and interview that he gives. He never tells the exact same story twice, adding details and removing certain aspects of his tale as he goes. This is just placeholder text as the true content is hidden within, but the content will discuss two major inconsistencies: the body location, and an entire tale of a visit to a state park.

Faulty Evidence

Final Thoughts

This is still placeholder text but this time it is for the topic of faulty evidence. There were bad cell records and people never tested the DNA collected at the crime scene. Jay's story also never lined up from 12-6 which is crucial, as it includes the time when the murder allegedly took place.

I'm going to leave this text box like it was- there is not much more to say. Insert your own text here. Talk about something related to your fourth topic or just put some placeholder text here. Jay's Inconsistencies

Jay Wilds was the key witness in the trial of Adnan Syed. As the trial did not have sufficient evidence to prove or disprive Adnan's involvement, the trial relied soley upon the testimonies of Jay. However, each time Jay tells the story, it changes. Most of these can be excused as a slip of the mind, but some are too major to be written off.

Major Inconsistency #1

The first major inconsistency of Jay's story, was the location in which Adnan allegedly showed Jay the body. Originally Jay showed the police some location along the highway. Later Jay specifies that Adnan showed him the body of Hae Min Lee at the parking lot of Best Buy. However, the map will show that these locations are nowhere near each other, so this can not simply be written off as a forgotten detail.

Major Inconsistency #2

The second major inconsistency was an entire segment of Jay's timeline. In his first interview with police, Jay told the police a very detailed memory of him and Adnan visiting Patapsco state park. Later this story completely disappeared. This simply can only be described as a lie.

Major Inconsistency #2

Bad Lawyer

The lawyer assigned to Adnan was Cristina Gutierrez. Throughout the trial, it becomes clear that she was not handling the trial effectively for two main reasons.

Reason #1

Cristina Gutierrez was disbarred only a year after Adnan's trial completed, for the mismanagement of client funds. Later evidence hints that Gutierrez was likely doing the same for Adnan's case. Meaning that Adnan likely recieved ineffective counsel.

Reason #2

The second reason that Gutierrez was not effectively handling the trial was how she disregarded a possible alibi for Adnan during the time that the alleged murder took place. Asia McClain wrote an an affidavit, claiming she saw Adnan in the library immediately after school.

Counter Argument #1

Some say that since Asia redacted her affidavit, it is void, and should no longer be considered as proof of Adnan's story. However, Asia later went back and stood by her original claims, meaning that her alibi for Adnan is still intact.

Counter Argument

Asia's affidavit

Faulty Evidence

In addition to the reasons metioned earlier, not all of the evidence used to "prove" Adnan's involvement in the murder is sound. There are two pieces of evidence where this is abundantly clear.

The state's timeline

#1

The state used cell records as their proof of Adnan's involvement. However, the story of their key witness doesn't match up with the cell records from 12-6, which is crucial, as that is when the murder is said to take place. The state has no proof Adnan was where he would've needed to be to commit the murder.

Unproven Evidence

The case was based on the use of cell phone towers to corroborate the story of the key witness. Incoming calls were used to corroborate Jay's story of the burial, but the cell companies stated that incoming calls were not reliable in placing location.

Counter Argument #2

Though I believe Adnan Syed is not guilty of the murder of Hae Min Lee mainly due to the reasons listed earlier, many think the opposite. My opponents may cite how Adnan never tried to contact Hae after she disappeared as proof he knew he would not be able to reach her, but he was simply acting like any normal teenager. Even Hae's current boyfriend at the time never tried to contact her that day. Both assumed they would hear the information from others as it came.

The End

Though some may say otherwise, I believe that Adnan Syed is not guilty in the murder of Hae Min Lee. I believe that Adnan was just a normal teenager who found himself in a series of very unlucky coincidences.` With all of the problems that happened in the investigation and during the trial, none of the evidence counted as "proof" actually proves anything. The evidence used neither proves nor disproves Adnan's involvement in the case. Even if you do not believe Adnan was innocent, I'm sure that everyone can agree the case was not handled correctly.
