Michael Minger was a sophomore living on-campus in Hester College on the fourth floor. He was a vocal music and journalism major. Michael had been diagnosed with ADHD, dyslexia and perception/spatial disorder. He died on September 18, 1998 from smoke inhalation that was due to a fire set in Hester Hall which was later determined to be arson.
May 1999
Michael's mom, Gail, filed a complaint on the basis of diversity jurisdiction. Her claim was against David Wilson (Associate Director of Housing) and Joseph Green (Director of Public Safety). She claimed that she called Wilson on Sept 14 to inquire about a fire on Sept 13 in Hester College and wasn't given all of the information necessary to determine the safety of her son. Her claim was that Wilson negligently misrepresented the cause of the Sept 13th fire by not mentioning the suspected cause of arson.
MSU agreed to pay $200,000 to settle the civil rights lawsuit. The Minger family was seeking $3-$4 million.
The Minger case was set in the Contemporary/Modern era of Higher Ed which also includes 9/11 and the housing/mortgage crash.
Foundational Theory:
Moral Development
Chickering's Identity Development
Integrative Theory:
Self-Authorship
3 Levels: pre-conventional, conventional, post-conventional
Moral reasoning develops through 6 stages.
Pre-conventional- societal rule and expectations are not understood. Perspective is concrete and individually focused.
Conventional- "Member of society"- identification with rules and expectations of others
Post-Conventional- "prior to society"- separation from rules and expectations of others to base decisions on self-chosen principles
Chickering's theory is not linear. Individuals move through the vectors at different rates, but the vectors do build on each other.
3 Elements of Self-Authorship:
trusting the internal voice
building an internal foundation
securing internal commitments
