Special Education Laws Timeline

Section 504 of the Rehabilitation Act (1973)

1973

- Banned discrimination based on disability by recipients of federal funds was modeled after previous laws which banned race, ethnic origin, and sex-based discrimination by federal fund recipients.

Individuals with Disabilities Act (1975)

- Originally Started as Education for All Handicapped Children Act (EHA)

1975

- Ensured that children with disabilities have access to free appropriate public education (FAPE), just like other children. It also states that schools have 60 school days to conduct an initial evaluation to determine if the child qualifies for special education services.

Under the IDEA, due process complaints are for disputes with the school involving the identification, evaluation, or educational placement of a child with a disability or regarding a provision of a free appropriate public education.

- Due to the EHA, the IEP was made when students with disabilities were introduced to the general public and ensured that they were getting the appropriate help they need.

The Handicapped Children’s Protection Act (1986)

All public schools receiving financial support from the federal government provide special-needs students with non-discriminatory access to all educational programs.

ADA (Americans with Disabilities Act) (1990)

- Protects people with disabilities from discrimination. States disability rights are civil rights.

No Child Left Behind Act (2001)

- The Act was made to hold schools accountable for the academic success of ALL students, including those with disabilities. Adequate Yearly Progress was made to track the student's success.

The Assistive Technology Act (1998)------->(2004)

2004

- Provides assistive technology to persons with disabilities so they can more fully participate in education, employment and daily activities on level playing fields with other people in their communities.
