DEFINITIONS

SEXUAL HARASSMENT is a form of sex discrimination. Unwelcome conduct on the basis of sex (of a sexual nature or otherwise): 1) by a University Official who conditions the provision of an aid, benefit, or service of the University on an individuals participation in that unwelcome sexual conduct; 2) determined by a Reasonable Person to be so Severe Pervasive and Objectively Offensive that it effectively denies a person equal access to the University's Education Program or Activity; or 3) Sexual Assault or Dating Violence, Domestic Violence, or Stalking based on Sex.

DEFINITIONS

COMPLAINANT - the person to whom the sexual misconduct allegedly happened

RESPONDENT - the person who allegedly committed the sexual conduct

SEXUAL HARASSMENT CAN BE:

  • Physical
  • Verbal
  • Non-verbal
  • Visual

QUID PRO QUO SEXUAL HARASSMENT:

"this" for "that" - unwelcome sexual advances, requests for sexual favors or other verbal, non verbal or physical conduct of a sexual nature, the submission to or rejection of which may result in an adverse educational or employment action

SOCIAL MEDIA EXAMPLES:

  • Sexually suggestive electronic postings including: pictures, videos, comments, conversations, etc.
  • Any form-Twitter, Instagram, TikTok, Facebook, YouTube, etc.
  • Electronic Stalking & Bullying of a sexual nature

SEXUAL ASSAULT OR SEXUAL VIOLENCE

an offense that meets the definition of rape, fondling, incest or statutory rape as used in the FBI's Uniform Crime Reporting System. A sex offense is any sexual act directed against another person, without the consent of the victim, including instances in which the victim is incapable of giving Consent.

Dating VIOLENCE

"violence committed by a person: who is or has been in a social relationship of a romantic or intimate sexual nature with the Complainant"

DOMESTIC VIOLENCE

a "felony or misdemeanor crime of violence"
