About the Republic Act 3573

AN ACT PROVIDING POLICIES AND PRESCRIBING PROCEDURES

ON SURVEILLANCE AND RESPONSE TO NOTIFIABLE DISEASES,

EPIDEMICS, AND HEALTH RELATED EVENTS, AMENDING FOR THE

PURPOSE REPUBLIC ACT NO. 3573 ENTITLED, "AN ACT PROVIDING

FOR THE PREVENTION AND SUPPRESSION OF DANGEROUS

COMMUNICABLE DISEASES AND FOR OTHER PURPOSES", AND APPROPRIATING FUNDS.

Sec. 01, Known as the "Mandatory Reporting of Notifiable Diseases and Health - Related Events Act of 2016"

Sec. 02, Declaration of Policy- to protect and promote the right to health of the people instill health consciousness among them.

Sec. 03, Definition of terms - for purposes, the following terms are herein defined:

•Communicable Diseases

•Disease

•Emerging Infectious Diseases

•Epidemic or Outbreak

•Infectious Disease

•Investigation

•Non-Communicable Disease

•Notifiable Disease

•Public Health Authority

•Public Health Emergency means an occurrence or imminent threat of an illness of health condition that

1.) Is believed to be caused by any of the following:

i bio terrorism

ii the appearance of a novel or eradicated infectious agent.

iii a natural disaster

iv a chemical attack or accident

v a nuclear attack or accident.

2.) Pose a high probability of any of the following harms:

i a large number of deaths in the affected population.

ii a large number of serious or long-term disabilities.

iii widespread exposure to an infectious or toxic agent that poses a significant substantial harm to large number of people in the affected population

iv international spread; or

v result to trade and travel restrictions.

Sec. 03, Definition of terms - for purposes, the following terms are herein defined:

•Public health threat

•Re-emerging infectious diseases

•Surveillance

Sec. 04, Objectives:

•to continuously upgrade the list of nationally Notifiable Diseases.

•to enforce mandatory reporting to public health authorities on diseases.

•to ensure establishments and maintenance of efficient and effective disease surveillance.

•to provide sufficient funding

•to require public and private laboratories to actively participate in disease surveillance

Sec. 05, Preparation and Updating of the list of Notifiable Diseases

-Epidemiology Bureau under the DOH shall be responsible for the preparation and updating of the list of notifiable diseases, syndromes and other health-related events and conditions.

Sec. 06, Mandatory Reporting

-The PIDSR system shall be recognized as the official system of the DOH in terms of disease surveillance.

Sec. 07, Assessment of Suspected Epidemics or Public Health Emergency

- all suspected epidemics or public health emergency shall be assessed by the DOH in coordination with national agencies, local; government

Sec. 08, Verification

- All health officers in provinces, cities and municipalities, disease surveillance officers shall promptly verify reports of epidemics received from health facilities, both government or private in all levels of governance or through community humors and shall immediately notify the DOH

Sec. 09, Deflation of Epidemic or Public Health Emergency

- the Secretary of health shall have the sole authority to declare epidemics of national and/or international concerns except when the same threatens national security.

Sec. 10, The Epidemiology Bureau

-The Epidemiology Bureau under the DOH shall have a nationwide scope of function and shall advocate foe evidence-based decision- making, public health surveillance, early response and outbreak management, epidemiological research and risk assessment at all levels of health system.

Sec. 11, Establishment of Epidemiology and Surveillance Units

- the DOH in coordination with the local government units, shall ensure the establishment of Epidemiology and Surveillance Units (ESUs)

Sec. 12, Prohibited Acts

- the following shall be prohibited under this act:

a) breach of privacy and confidentiality

b) non-performance of the operations of the PIDSR

c) non-operation of person

Sec. 13, Penalties

- any person or entity found to have violated sec. 12 of this act shall be penalized with a fine if not less than 20,000 but not more than 50,000

Sec. 14, Appropriation

- the DOH shall included in its program the implementation of this act.

Sec. 15, Implementing Rules and Regulations

- the DOH shall issue the implanting rules and regulations for this Act within 120 days after the approval of this act.

Sec. 16, Separability Clause

- if any part, section or provisions not affected thereby shall remain in full force and effect.

Sec. 17, Repealing Clause

- All other laws, decrees, orders, issuances, and rules and regulations or parts thereof inconsistent with this act are hereby repeated and modified accordingly.

Sec. 18, Effectively

This act shall take effect 15 days after its publication in the official Gazette in any news paper of general circulation.

it aims to require public and private laboratories to actively participate in disease surveillance through the following:

-Assurance of the availability of appropriate laboratory tests and reagents and on-going technological and training support for new and classic methods of notifiable disease detection and identification of other health-related events and conditions;

- The establishment of linkages with clinical, veterinary, agricultural, and academic laboratories to share expertise, services and identify laboratory surge capacity for any public health emergency.
