"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."

PROGRAM 1

Sex, Gender, and Gender Expression

  • Schools are held accountable for what they know, or reasonably should have known.

  • School employees are required to act immediately, and report to administration.

  • If admin is dismissive or unresponsive, there is an obligation to continue up the chain of command. (you are protected from retaliation).

The department of education issued this DCL to explain that the requirements of Title IX cover sexual violence and to remind schools of their responsibilities:

Once a school knows or reasonably should of know of possible sex violence, It must take immediate and appropriate action to investigate or otherwise determine what happened.

If sexual violence has occurred, a school must take prompt and effective action to end the sexual violence, prevent its reoccurrence, and address its effects, whether or not the sexual violence is the subject of a criminal investigation.

The school must take steps to protect the complainant as necessary, including interim steps taken prior to the final outcome of the investigation.

Provide a grievance procedure for students ...

Provide a grievance procedure for students to file complaints of sex discrimination, including complaints of sexual violence. The procedures must include an equal opportunity for both parties to present witnesses and other evidence and the same appeal rights.

The grievance procedures must use the preponderance of the evidence standard to resolve complaints of sex discrimination.

A school must notify both parties of the outcome of the complaint.

Scenarios

In a local school, a pattern of boys taunting and cat-calling female students has emerged over the course of the year. One day during class Josh called Elena, a classmate, a slut and whore. She left crying and went into the locker room.

You find out that a local private school that has strict uniform regulations for boys and girls skirts changed the distributor of their uniforms and now skirts are substantially tighter. You are told by several girls who are larger sizes that the skirts they are getting pulled out of class into in school suspension/detention for uniform violations based on length of skirts.

An openly gay junior in high school is often teased about his sexuality. His car is vandalized on several occasions, and he is taunted in the hallways for wearing non-normative clothing, and hairstyles, One day, he confronts an attacker, a peer who is in his gym class, who then challenges him to a fight. While still on school campus, the fight breaks out, and is quickly dissipated by administration. The peer is given detention for several weeks, and the young man suspended for 3 days. The principal advised the young man to not dress so flamboyantly, so as to avoid unwanted attention.

A high school student reports a sexual assault and the perpetrator shared many classes with the survivor. The school responds by making the survivor change their classes and routes at school to avoid interactions.

A college student is assaulted in the dorms after a party. The incident is reported to the Title IX coordinator. The perpetrator lives in the dorms with the survivor.
