The Brady Act, passed in 1994 and signed by President Bill Clinton, made background checks a requirement before purchasing a gun from licensed stores. INTEREST GROUPS

Interest Groups

Brady, confined to a wheelchair and unable to resume his duties, campaigned vigorously for the bill, despite fierce opposition from the National Rifle Association (NRA), one of Washington’s most-formidable interest groups.

Supported By Many Americans and The Brady Campaign

1. Gun ownership demands responsibility.

2. Laws in existence must be upheld by those empowered to do that job.

3. Gun violence is a uniquely American problem. Only when Americans unite and work together will it be solved.

"Brady’s multi-pronged approach of education, litigation, and legislation will ensure that every community is safe, not only from mass shootings, but from the daily urban gun violence that plagues so many American cities. It’s time we unite people from coast to coast, liberal and conservative, young and old, fed up and fired up, to work with us and end the gun violence epidemic." - The Brady Campaign

HOW IS THE BRADY BILL IMPLEMENTED?

BUREAUCRACY

Brady became a leading proponent of gun-control legislation and in 1987 succeeded in getting a bill introduced into Congress. The Brady Bill, as it became known, was staunchly opposed by many congressmen, who, in reference to the Second Amendment to the U.S. Constitution, questioned the constitutionality of regulating the ownership of arms. In 1993, with the support of President Bill Clinton, an advocate of gun control, the Brady Bill became law.

STATE AND FEDERAL

Providing the strongest evidence yet of the ascension of state power at the Supreme Court, a bitterly divided Court ruled today that the Brady gun control law violated they're very principle of separate state sovereignty by requiring state officials to conduct background checks of prospective handgun purchasers. They have limited the Brady bill a decision for the state government instead of the federal government.

POLICY ANALYSIS

ANALYSIS

Today, 40% of gun sales do not go through a background check because they take place online, at gun shows, or through classified ads. Mass shootings, like Pulse Night Club in Orlando and the 2017 country music concert in Las Vegas, have sparked disagreement about gun control laws, including background checks. Gun control is a polarizing topic, and there is debate whether strict gun control laws can prevent homicides or suicides.

CHANGES

SUGGESTIONS

Unchecked sales occur at gun shows across the country and over the Internet every single day. Current legislation pending in the U.S. House of Representatives would solve this problem by expanding Brady background checks to all gun sales including sales made over the Internet and at gun shows The Brady Campaign isn’t waiting for Congress to act. Since 2013, six states have passed new laws expanding Brady background checks to all gun sales. This is tremendous momentum ultimately Congress won’t be able to ignore the will of the people as more and more states act.
