In the year of our Lord, twenty hundred and twenty three, we, the People of the United States of America, in order to safeguard the welfare and well-being of our citizens, do hereby propose the following Constitutional Amendment, to be known as the Amendment of Medically Assisted Abortions.

• The right of an individual to seek and obtain a medically assisted abortion, performed by a qualified and licensed medical practitioner, shall not be infringed upon by the laws of this land.

• The right of an individual to undergo a medically assisted abortion shall rest solely with the pregnant person, free of coercion and interference.

• The government shall uphold the legal and regulatory framework necessary to ensure medically assisted abortions are kept confidential and healthy manner, taking into account the well-being of the pregnant person.

• The rights and protections afforded under this Amendment shall extend to all individuals regardless of race, gender, religion, or socioeconomic status. No person shall be compelled to participate in an abortion if their religion rejects such a practice.

• Congress shall have the power to enforce and implement this Amendment through appropriate legislation.

Background

The right of being able to have abortions was given by the supreme court case Rowe vs. Wade in the late 1900s. As of early 2022, the case was overturned and is now up to the states as to whether the practice is legal or not.

The ability for a woman, trans man, or non-binary person to have an abortion is extremely important. It is their body, and their life, while there is more “life” at stake here, the mother would be responsible for the child regardless, and if the mother claimed it would interfere with their life too much, then rid of it without question. Some religions and some people’s morals conflict with that, and that is fine for them. For those who do want it though, they should be able to if people are able to choose not to. Every individual is different and every situation varies, so respect other people’s decision and let them choose what they want. Without this amendment, women and other people who can get pregnant are losing their rights to control their body and lives. If forcing a woman to keep a baby is a law, then the responsibilities of it should not be solely on her (as they are now). Without this amendment many women’s lives are being ruined due to financial struggles, lack of shelter for the child, etc. not only causing stress on the mother, but making a poor living environment for the child. The Mother should be the one to judge whether or not she can handle the baby, and if not, should have the right to have an abortion that is medically assisted and safe.

Impacts & Effects

This amendment would mostly impact women in the age range of 14-24 (roughly, but ALL ages are impacted for sure). Having the right to have an abortion is a huge step in the right direction for women’s rights. A large part of why women cannot have abortions (although not legally stated) is due to the father not wanting the baby to be killed, but it should be the mother’s choice as it is her who actually suffers for the baby. This amendment would make for a good jump in women’s rights in America, providing more choice and more individualism for women, being able to live their own lives and make their own choices, equal to men.

Reaction

Reaction would be very partisan, because most democrats will support abortion and most conservative will be against abortion. Democrats almost always fall under the pro-choice category and conservatives in pro-life. I think the reaction would be overall positive because while conservative women are more conservative, a lot of republican party females will support abortions because it is a woman's rights matter.

Process

I think that this amendment should start in congress because it would be more likely to go through. The majority of states are republican majority because of many small states being red.
