“It appears from these articles that there is no need of any intervention of the state governments, between the Congress and the people, to execute any one power vested in the general government, and that the constitution and laws of every state are nullified and declared void, so far as they are or shall be inconsistent with this constitution, or the laws made in pursuance of it, or with treaties made under the authority of the United States. — The government then, so far as it extends, is a complete one, and not a confederation.”
Brutus argues that the best form of government for the U.S. is a confederacy; he argues that a republic is insufficient because the U.S. has too much territory and the federal government will take advantage of its power.
“[...] when the federal government begins to exercise the right of taxation in all its parts, the legislatures of the several states will find it impossible to raise monies to support their governments.”
Significance: Brutus argues that with the power of taxation given to the federal government, it will make it a lot harder for the state governments to get funds, causing their representation and powers to be diminished.
“These courts will be, in themselves, totally independent of the states, deriving their authority from the United States, and receiving from them fixed salaries; and in the course of human events it is to be expected, that they will swallow up all the powers of the courts in the respective states.”
“[the supreme courts] will swallow up all the powers of the courts in the respective states”
Significance: He states that the supreme court will swallow up the lower (state) courts, causing their decisions to be completely ignored and trumped by whatever the supreme court decides.
"It is natural for a republic to have only a small territory, otherwise it cannot long subsist.”’
“The Grecian republics were of small extent; so also was that of the Romans.”
Significance: He argues that the views of so many people can’t be taken into account accurately with such a small amount of legislatures; everyone’s issue will not be able to be satisfied because the government simply won’t have enough manpower to listen to all of its citizens. He uses the example of small yet successful governments such as Rome and Greece, stating that they were successful when they were so small, but deteriorated as they grew in size.
“there will be a constant clashing of opinions”
“the government will...operate upon the fears of any faction which may be oppressed to it...to prevent an opposition to the execution of the laws
Significance: Due to so many differing public opinions, the federal government will not be able to keep every single person satisfied. Brutus argues that the government will have to result to force in order to control its people, causing the U.S. to turn into a tyrannical government to maintain order.
