Dred Scott Decision

In 1857, a slave named Dred Scott sued for his freedom- he argued that since his owners had once brought him to live with them in a free state, he should be free.

“For the establishment of liberty and the overthrow of the Slave Power.”

The court's decision was hugely pro-slavery. Since slaves were "property," said Chief Justice Robert Taney, the fifth amendment kept the government from taking him away from his owners.

In essence, this meant that the Constitution supported slavery.

Other southern states: "Yeah, we're out too."

South Carolina: "We're out."

Jefferson Davis was chosen as President

Attack on Fort Sumpter by South Carolina

The War Had Begun

When others tried to bring them back, one southern leader said: "We spit on every plan to compromise."

Most southerners celebrated, but others weren't so sure....

"I see only that a fearful calamity is upon us....."
