Treaty acts as an agreement under international law; an agreement, protocol, covenant, convention, pact, or exchange of letters, among other terms. Treaties, MOA and MOU formulated for the security and political goals of the Philippines and Switzerland are as follows:

Extradition is the official process whereby one country transfers a suspected or convicted criminal to another country,

MLAT provides for the sharing of information and evidence related to criminal investigations and prosecutions, including drug trafficking and narcotics-related money laundering

Its purpose is to ensure that Swiss and Philippine nationals receive equal treatment, wherever possible, in respect of their social security entitlements

  • Treaty of Extradition Between the Republic of the Philippines and Switzerland

• Treaty on Mutual Legal Assistance in Criminal Matters between the Philippines and the Swiss Confederation

• Agreement on Social Security between the Philippines and the Swiss Confederation

• Agreement between the Republic of the Philippines and the Swiss Confederation on the Readmission of Persons with Unauthorized Stay

• Agreement between the Republic of the Philippines and the Swiss Confederation on the Performance of Remunerated Activities by Dependants of Members of Diplomatic Missions, Consular Post and Permanent Missions

• Agreement on the Abolition of Visa Requirements for Holders of Valid Diplomatic and Official Passport between the Government of the Philippines and the government of Switzerland

D. ECONOMIC RELATIONS

  • JANUARY 1992 - The Swiss government ordered the protected seizure of $80 million deposited by the family of the former Philippine dictator, Ferdinand Marcos and an associate who had money in Geneva Banks. This freezing of assets was permanent and the family could not touch it until the courts decided ownership. Manila is seeking to recover $365 million allegedly held by the late president and his associates in secret swiss bank accounts.

  • JUNE 1988 - President Corazon Aquino left the country in order to seek aid to repay the heavy debt the Philippines has been burdened with. She flew to Bern to meet with the Swiss government in order to plead for a speed up in the recovery of an estimated $1 billion in embezzled funds that President Ferdinand E. Marcos allegedly stowed away in Swiss accounts.
  • In February 2014 – The Philippines and Switzerland successfully concluded their 6th Bilateral Consultations on February 27 at the Tower Club in Makati City, vowing to intensify bilateral economic and political cooperation and partnership.

  • In April 28, 2016, representatives of the EFTA states signed the free trade agreement with the Philippine Minister of Trade and Industry. The free trade agreement involves trading in industrial and agricultural products, services, the removal of non-tariff trade barriers and the protection of intellectual property.

  • Furthermore, negotiations for a Free Trade Agreement between the EFTA-States and the Philippines were launched on 24 March 2015, a total of five rounds of negotiations were held and they were concluded on 6 February 2016. The competent Ministers have signed the Agreement on 28 April 2016.

  • Major Swiss exports to the Philippines are pharmaceuticals, vehicles/aircraft, non-electric machines and watches, while major Philippine exports to Switzerland are traditional electric machines, non-electric machines, agricultural products and optical-medical instruments.

  • Swiss businesses have a significant presence in the Philippines, among them well-known companies such as Roche, Zuellig, Nestle and SGS, among others.
  • Agreement Relating to Air Services between the Republic of the Philippines and Switzerland was signed in Manila on March 8, 1952 This treaty considers the fact that commercial aviation for the purpose of transport and travel has increased between the two states and that it is desirable for the both countries to organize regular air travel.

  • The Treaty on Extradition between the Republic of the Philippines and Switzerland was signed in Berne on October 19, 1989, The Treaty was made with the desire to provide for a more effective cooperation between the two states in the repression of crime.
  • Before the Second World War, some 15 Swiss companies were active in the Philippines, mainly in international trade, the timber industry and plantations.

  • In 1979 Switzerland was the fourth-largest foreign investor in the Philippines and economic relations developed at a rapid pace during the following decades.

  • In 2012, Switzerland ranked as the 16th largest merchandise trading partner of the Philippines in terms of exports value and bilateral trade stood at US$ 657 million while Swiss investments in the Philippines amounted to US$ 290 million.

  • In June 2013, the Agreement on the Establishment of the PHL-Swiss Joint Economic Commission (JEC) - a major platform in enhancing trade and investment ties between the two countries was signed, which was ratified on 19 December 2013.

A. SIGNIFICANCE OF SWITZERLAND TO THE PHILIPPINES

F. RECOMMENDATIONS

The Swiss confederation officially recognized the Republic of the Philippines on July 4, 1946. The two countries first established their diplomatic relations on August 30, 1956. In 1862, Switzerland established an honorary consulate in Manila, its first diplomatic outpost in Asia. At present, The Philippine Embassy is located in Bern, Switzerland and The Swiss have their Embassy in Manila.

ECONOMIC "Investment protection"

Comprehensive investment protection should be done or implemented to secure economic relations between the Philippines and Switzerland since it is extremely important to the both economies.

SECURITY AND POLITICAL "Foreign Aid"

The DFA will provide assistance only from the time when the persons concerned have done everything that could reasonably be expected of them to remedy a situation of distress by organizing and obtaining the necessary financial means.

SOCIO-CULTURAL "Exchange of Professional and Technical Trainees"

Strengthen the support of both countries by providing and training workers to actively promote the two-way exchange of trainees, from various professions, including nursing and healthcare

  • Treaty of Friendship between the Republic of the Philippines and the Swiss Confederation (Signed in Manila on 30 August 1956);
  • Agreement between the Republic of the Philippines and the Swiss Confederation on the Promotion and Reciprocal Protection of Investment (Signed in Manila on 31 March 1997);
  • Agreement between the Republic of the Philippines and the Swiss Confederation on the Readmission of Persons with Unauthorized Stay (Signed on 9 July 2002);
  • Agreement on the Abolition of Visa Requirements for Holders of Valid Diplomatic and Official Passport between the Government of the Philippines and the government of Switzerland (Signed in Manila on 19 October 1973).

Among the agreement's objectives are:

  • Identify the means to increase bilateral trade and investment flows;
  • Facilitate trade and investment
  • Examine opportunities to conclude economic agreements
  • Organize consultations and official visits to deal with specific economic and trade issues of interest to both parties
  • Establish a mechanism for regular data exchange on trade and investment
  • Enhance cooperation and develop initiatives with relevant business associations

After the establishment of diplomatic relations between the Philippines and Switzerland on 30 August 1956, Ambassador Salvador P. Lopez, Philippine Ambassador to Paris, was concurrently accredited to Berne on 21 June 1957. Ambassador Tomas de Castro was the first resident Philippine Ambassador accredited to Switzerland

B. ISSUES AND CONCERNS

Official/state visits of Philippines to Switzerland occurred in and by: Corazon Aquino in June 1988 for a state visit, Gloria Macapagal-Arroyo in January 2007 for the World Economic Forum Summit, Gloria Macapagal-Arroyo in January 2008 for a Working Visit/ Summit – WEF 2008, Benigno S. Aquino III in January 2013 for the World Economic Forum Summit.

The following served as Chargé d’ Affaires for at least three months: Tomas G. de Castro (1958-1964); Rolando A. Garcia (1969-1972); Domingo L. Siazon, Jr. (1973); Teresita V. Prado (1978); Luis V. Switzerland has always worked closely, cooperatively and hard with the Philippines to return all of the assets in terms of money that it froze during the regime of late dictator, Ferdinand Marcos.

c. SECURITY AND POLITICAL RELATIONS

  • Close economic relations developed between Switzerland and the Philippines since the middle of the 19th century, when the Philippines was still a colony of Spain. A Swiss consulate was opened in Manila in 1862 at the initiative of Glarus entrepreneur and National Council member Peter Jenny - the first Swiss consulate in Asia.
  • On July 4, 1946, Switzerland officially recognized the Philippines as a country.
  • In 1957 formal diplomatic relations between the two countries were established. The two countries maintain good and long-established relations, which are characterized by regular political dialogue, extensive trade and ad hoc Humanitarian Aid operations after natural disasters.

E. SOCIO-CULTURAL

Since the establishment of diplomatic relations and mission of the Philippine and Switzerland, exchanges between the two countries have flourished, particularly in the economic, cultural, social and political spheres. Collaborative efforts have also been strengthened through the signing of numerous agreements.

There are more than 22,241 Filipinos in Switzerland; and as of 2012, there are 3,140 Swiss nationals residing in the Philippines, with 1,664 of them holding dual citizenship.

Treaties and agreements between the Philippines and Switzerland involving social and cultural concerns are as follows:

• Agreement between the Republic of the Philippines and the Swiss Federal Council on Exchange of Professional and Technical Trainees- allows the exchange of trainees between the two countries, at 50 trainees per year per country. Under this program, training candidates must meet the educational requirements of their respective professions or field of work, and must be between 18 and 35 years of age. Trainees will be engaged in regular work in the institution /company that hire them for a period of not more than 18 months, and will be duly compensated and receive benefits in accordance with the labor laws of host country.

• Memorandum of Agreement on Recognition of Certificates of Competency and Training of Seafarers for Service on Board Vessels Registered in Switzerland between the Swiss Maritime Navigation Office on Behalf of the Government of Switzerland and the Maritime Training Council on Behalf of the Republic of the Philippines
