Doli Incapax

What is Doli Incapax?

Doli Incapax is when someone is incapable of crime. The age limit is 11.

Notes

When someone accuses somebody else of commiting a crime, they have to prove that

they knew what they were doing or what the consequences are.

  • School files and criminal records would be checked.
  • Parents, teachers and friends would be asked about the behaviour of the child.

Britain’s jails are full, but are they full of the right people?

A huge number are on remand – and are subsequently

found not guilty of the charges on which they were remanded.

This shows an average of more than 12,000 ultimately innocent defendants are locked up on remand every year.

Innocent people shouldn't go to jail, nor should 10 year olds

Results

What are the benifits of this.

If the child doesn't understand the consquences, they're most likley to not understand why they are going to jail.

Also if a child is locked up, not understanding why, with really bad children they could influence him/her, into doing real bad.

We all think that Doli incapax is the right way to go. We think this because locking up a child, and them not understanding why, is wrong.
