What it says in the Charter
6. (1) Every citizen of Canada has the right to enter, remain in and leave Canada.
Rights to move and gain livelihood
(2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right
(a) to move to and take up residence in any province; and
(b) to pursue the gaining of a livelihood in any province.
It means that every Canadian citizen has a right to freely leave or stay in Canada.
Everyone who's been living in Canada for a certain amount of time has the right to move to a different province and to get a job, with the freedom of living the way you want.
The Mobility Rights are important because without it, we citizens of Canada wouldn't be able to go anywhere without the risk of breaking laws. Also it's important because families wouldn't be able to go on vacations out of Canada. Another example is if you want to leave Canada and move to your family in another country or province you wouldn't be able to leave.
Mobility rights relate to us citizens of Canada because without it we wouldn't be able to travel or move out of Canada freely.
In 1984 a South African citizen named Joel Skapinker who lived in Canada for some time, applied to the Ontario Bar to practice law. They refused his application as the Law Society Act required that he be a Canadian citizen. Skapinker says that they violated his rights, Section 6(2)(b) of the Charter.
On Appeal, the court held that his mobility rights were in fact violated
Lets say you wanted to move out of Canada or travel somewhere out of Canada. Wouldn't you want to have the right to move/travel freely? Then do something about it.
- let people know they have the right to do so
- If people don't know, teach them
- Help spread the information
- Take advantage of it
