ELL Court Cases

"No person individually or as a teacher, shall in any private, denominational, parochial or public school, teach any subject to any person in any language other than the English language."

Meyer v. Nebraska 1919

Siman Act

An act relating to the teaching of foreign languages in the state of Nebraska.

Teachers could not teach any language but English until a student passed the 8th grade.

"No State shall...deprive any person of life, liberty, or property, without due process of law."

Stainbeck v. Mo Hock Ke Kok Po 1947

The statue prohibited the teaching of a language other than English to all children who had not passed the first four grades of public or private school.

Parents believed they were entitled under the Due Process clause of the 5th and 14th Amendments.

This case attempted to restrict Japanese heritage language programs.

Restricting Foreigen Language in School

These cases were more about fear after WWI and WWII. School instruction in these languages were dropped for the fear that German and Japanese Americans would not be loyal to the United States.

This case had to do more with parents' rights in directing the education of their children than with language rights.

10 year old boy being taught German reading skills using the bible by teacher Robert T. Meyer who was tried and convicted.

June 4, 1923

Supreme Court declares violation of Due Process clause of the 14th Amendment

Ruling was decided on the basis of the 1927 Farrington v. Tokushige case.

Ruling

March 14, 1949 Supreme Court issued 9-0 decision and upheld the law in question.

Case made it clear The 14th Amendment provides protection for language minorities.
