Helling vs. Mckinnley

The Case

William Mckinnley, a Nevada State

prisoner, sued his warren and several other prison officals for violating his Eighth Amendment rights by subjecting him to unhealthy levels of second-hand smoke.

McKinney shared a cell with a man who smoked five packs of cigarettes a day. He claimed that the prison officals did not care about his personal health.

The Verdict

Mckinnley won the case by a 7-2 vote in the supreme court.

I believe that if you are sent to prision for any reason, your constitutional rights are taken away. Mckinnley should not has won, because he is a prisoner and should have no right to sue.
