Frederick vs morse case: 551 U.S. 393 (2007)

How it began.

in 2002 a highschool seniors 14 foot banner with the quote "Bong his 4 jesus" gave the supreme court an argument over the schools control over freedom of speech from the first amendment.

The argument.

It began when the school suspended the senior joeseph Frederick for promoting illegal drug use at a school sancioned and supervised event because of his banner which he unraveled across the street from the school.

A question.

At what point should the school be able to infringe students rights to the first amendment?

In their eyes

In the schools eyes the banner appeared to promote illegal drugs use which was a violation of school policy resulting in out of school suspension.

In the students eyes the school was unfair to their freedom of speech and that the school had no power because when the students presented the banner they were not on school property.

The Ruling

The court ruled that schools can limit free speech of students if it is promoting illegal drug use. A 5/4 vote that favored a conservative ideology the case more closely paralleled Bethel school district vs Fraser in 1986. supreme court upheld the schools right to disipline students using the obscene or profane guestures and language under their disruptive conduct code.

The effect it left on students and schools both was that anything can happen and not everything is covered under the amendments even if they appear to be. students must learn that they are not invincible at school and should learn to put a filter on while talking and watch who they are talking to. As for schools, they should not take things as seriously as they do take manners such as this is was all in good fun but sometimes the scene can be obscene and offensive.
