Affects of ruling

Juveniles can no longer be tried as adults after they have already been tried in juvenile court. The first thing the courts now decide is whether to try them as adults or juveniles before they proceed with the case.

Ruling

The State Court, Superior Court, and District Court all denied the writ of habeas corpus.

The Court of Appeals reversed the finding of the lower courts and the Supreme Court upheld this decision.

  • Gary Jones, age 17, was adjudicated delinquent in Los Angeles Juvenile Court for armed robbery.
  • At the disposition hearing, the judge waived jurisdiction to criminal court.

Adjudicated Delinquent- a youth who has violated a criminal law, as determined by a juvenile court judge.

  • Under the juvenile system, youths are called delinquent rather than guilty
  • An adjudication, a judicial ruling, must occur before punishment is imposed for the delinquent act

Double Jeopardy- a second prosecution for the same offense after acquittal or conviction or multiple punishments for same offense
