Before Wainwright

The right to legal counsel was extended to include state prosecutions, regardless of income.

  • Gideon could not afford a lawyer since he was poor
  • The Florida court wouldn't allow him to receive counsel
  • Gideon testified himself, and was given 5 years in prison

How Did Wainwright Get Involved?

Gideon appealed to the United States Supreme Court and sued H.G. Cochran. However, Cochran soon retired, so Wainwright was assigned to the case.
