The End

WHAT IS YOUR REACTION, WAS PRIVACY BREACHED?

WHAT IS A SOUTH AFRICAN OR OTHER GLOBAL EXAMPLE YOU CAN THINK OF?

Alternative Approaches to the case

  • Maintaining confidentiality for Christine's family
  • Avoiding unnecessary breaches of information that detracts from the main investigation of the alleged assault
  • Pursuing questions beyond drinking habits, instead about his history towards abusive behavior with women
  • Avoiding releasing names of family members and friends that did not wish to be involved in the case until after the ruling

12:50 CT/1:50 ET: Christine Blasey Ford says she does not know how her letter detailing the alleged assault became public

"It was my understanding that it was going to be kept confidential, period," Ford said she provided the letter to U.S. Rep. Anna Eshoo and asked that it be delivered to Sen. Dianne Feinstein.

"I believed he was going to rape me... It was hard for me to breathe, and I thought that Brett was accidentally going to kill me. Both Brett and Mark were drunkenly laughing during the attack. They both seemed to be having a good time."

Black White and Gray Questions...

“People are entitled to keep details of their private lives to themselves. The publication of embarrassing facts can be an invasion of privacy. But this is one area where people are not treated equally. Ordinary people have significant rights to privacy, but celebrities, politicians, and others who live their lives in the public eye forfeit a large part of these rights.”

“The public has the right to know what their elected representatives and other officials are doing. Where private behavior touches on the suitability for public office, then that justifies is very clear.”

WHAT EXACTLY IS THE PUBLIC INTEREST IN THIS STORY?

HOW IMPORTANT IS IT?

HOW WILL THE PEOPLE INVOLVED BE AFFECTED BY THE INVASION OF THEIR PRIVACY?

HOW MUCH PROTECTION DO THEY DESERVE?

ARE THERE ALTERNATIVE APPROACHES THAT MIGHT REDUCE ANY RISK OR HARM TO THEM?

ETHICAL ROAD

Brett Kavanaugh

  • Case questioned Mark Judge, a former high school friend "I did not ask to be involved in this matter nor did anyone asked me to be involved."
  • Christina King came forward and tweeted of Kavaunagh's guilt but "In a subsequent tweet, King said she scrapped the post because she was taken aback by the media interest it prompted" (Washington Post).
  • Unintended consequence: Kavaunaugh's wife Ashley recieved a slew of death threats

  • Statements released and investigations around his drinking habits and bar disputes in college.
  • Political investigation as "some Democrats said Kavanaugh’s statements in the hearing about his drinking and about remarks in his high school yearbook were misleading" (The Advocate).

Background

- New Supreme Court Justice Brett Kavaunaugh nominated by President Trump in 2018

- Supreme Court Justice is chosen to determine the law of the land and be as equal, unbiased, and fair as possible

- Shortly after nomination, story comes to forefront with sexual assault allegations

BLACK WHITE AND GREY STOPS AHEAD...

On September 12, The Intercept reported (without naming Ford) that Feinstein was withholding a Kavanaugh-related document

from fellow Judiciary Committee Democrats.

On September 13, Feinstein referred Ford's letter to the FBI, which redacted Ford's name and forwarded the letter to the White House as an update to Kavanaugh's background check.

On September 16, after media reported anonymous allegations and reporters started to track down her identity, Ford went public.

1991 vs. 2018

Anita Hill (1991) comes forward with sexual harassment allegations against Clarence Thomas, he is still offered position in the Supreme Court

Christine Ford (2018) comes forward with sexual assault allegations against Brett Kavaunaugh, and he is still appointed Supreme Court Justice

Role the media played: facilitative role and radical role
