ORIGINAL SOLUTION

-- Bill Clinton signed the "Brady Handgun Violence Protection Act" on November 30, 1993

-- Effective February 28, 1994

-- Changed the lie-then-buy system into a background check-then-buy system

-- Required that every gun sale by a licensed dealer be "referred to law enforcement for a background check"

ORIGINAL PROBLEM/ISSUE

Under the Gun Control Act, people who are considered high-risk could still purchase guns by giving false information on their reasons for gun purchase.

President Ronald Reagan and officials were shot in March 1981 in an assassination attempt by shooter, John Hinckley, who lied about his address when he purchased the gun with an expired license.

A background check would have caught that lie

ONGOING ISSUES/CONCERNS

--People against it feel that the Act infringes on the 2nd amendment and should be repealed to reserve rights to own guns and protect ourselves

--People in favor of the Act say that guns have been killing been for years and are no longer required for our safety

--"Stand Your Ground Bill" in Florida has directly resulted in shootings since it was passed but overall crime rate has drastically decreased

--Federal government is pushing for federal regulation while states don't want federal government to take away their right to regulate guns

BACKGROUND INFO

NATIONAL GOVERNMENT'S ROLE

-- Within 5 years to establish instant background checks on criminal/mental illness records preventing purchase of firearms

In 1960, the U.S. suffered from the assassination by gunfire of Martin Luther King Jr., President John F. Kennedy and Senator Robert F. Kennedy.

-- 5 day waiting period before receiving requested firearms

-- No sales of guns from unlicensed dealers to others without a statement of eligibility

Congress responded to the public outrage by proposing the Gun Control Act of 1968, identifying lists of people who are of high-risk to own a gun.

STATE GOVERNMENT'S ROLE

-- Stealing a firearm includes a fine of up to $10,000 + imprisonment

-- Enforce the established laws

These lists include felons, youth, and the mentally ill

ARGUMENTS FOR:

Many have been killed by weapons and attempts on politicians lives wouldn't have happened if these laws were in place

-- DO background checks and monitor distribution of firearms

-- Provide criminal records for background checks

PROBLEM:

Argued it violated the 2nd amendment and that it was up to the state to decide its gun regulations because it's not stated in the Constitution
