Exclusionary Rule Timeline

1918- Silverthorne Lumber Co. vs. United States

Conclusion

This U.S. Supreme Court case established the "fruit of the poisoned tree" doctrine, which prohibits the admission in federal courts of indirect as well as direct evidence obtained illegally.

Several other rulings in the past few years have created 'exceptions' to the "exclusionary rule", including 2006-Hudson vs. Michigan, 2009-Herring vs. United States, and 2010-Berghuis vs. Thompkins.

The "exclusionary rule is an intricate part of the criminal justice system and "due process".

1949- Wolf vs Colorado

This U.S. Supreme Court case incorporated the "exclusionary rule" as a state right. Not all states adopted the "exclusionary rule" under their 'procedural laws'.

1914- Weeks vs. United States

1961- Mapp vs. Ohio

This U.S. Supreme Court Case established the "exclusionary rule", which prohibits the admission in federal courts of evidence obtained in violation of 4th Amendment rights.

This U.S. Supreme Court case required that all states adhere to the "exclusionary rule". The Mapp ruling now required states to include the "exclusionary rule" as a part of their 'procedural laws'. Failure to do so would result in lost evidence.
