The supreme court unanimously voted in favor with swann, allowing florida's students to be moved around to fufill certain "quotas" increasing diversity and integration within our own culture. Other states soon followed Florida's example, allowing the school system to finally become truly diverse.

The Integration of the races is a state issue that the states will gradualy resolve. Even if it is not immediently plausible. There is no incentive in the constitution to forcefully integrate high school kids, meaning that the bussing system was not required

Swann's Argument

Even though De Jure segregation is outlawed, de facto segregation is very much present and should be altered through any means possible - even if it infringes on the state's decision. Bussing should be enabled due to the fact that:

  • The school's racial profile violated the equal protection clause of the 14th amendment
  • The segregation did not allign with Brown v Board of Education's verdict: the diverged population violated the constitution

Background Information

Despite the previous Brown v Board of education ruling, segregation was very much present in many schools; In North Carolina, some schools contained a population of nearly 99% Black students due to its very centralized population, with the blacks gathering towards the middle and the whites lying on the outscirts. Swann was selected to be represented in a court to integrate the black community by busing its populus around. After a series of federal court cases, the case was taken to the supreme court.
