Carey v Population

by

Quinton and Jeremiah

Both sides argument

What did each side say?

- The opposing argument was between Carey and population services. Carey's service side agreed that preventing teenagers from getting a contraception unless they tell a parent does not decrease sexual activity.

Background Information

Impact on Society

Ruling

What was the outcome?

-7 of the nine judges voted for Population Services Int. and the other two voted against.

What was the majority opinion?

- Brennan gave majority opinion.

What was the dissenting opinion?

- Justice Reihnquest was one of the two justices that believed that the Education laws, were to prevent kids under the age of 16 to not have sex.

What happened?

- This Supreme court case was argued January 10, 1977. The court case was decided June 9, 1977. The court case prohibited any person to sell or distribute any contraceptive of any kind to a minor under the age of 16.

Why did the case go to court?

- Because it was illegal to get contraceptives below the age of 16 because of the Education law.

How does it affect american citizens?

- It affects americans because in today's society, getting contraceptives for young individuals to try to prevent pregnancy is huge. So is the sex rate in high school now a days. So younger females turn to that as a back up plan.

What do we think about the outcome?

Quinton

- I personally feel teenagers under age 16 should receive a contraceptive with or without a parent. It is not easy to talk to adults about sex. Children should have access to contraceptives and also more privacy.

Jeremiah

- I believe that its hard to judge. Mainly because the contraceptive has the same purpose of a condom because it is to prevent pregnancy and in other form of disease. However, teenagers have a tendency to misuse medication or drugs sometimes.
